1. Introduction and validity  

This document serves to present in one place the principles for the processing of personal data and for the usage of cookies (collectively referred to as "Policy") by BattSwap CZ s.r.o. (the "Company").

The Policy has been issued in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR) and other laws and legal regulations in force in the Czech Republic.

The Policy has come into effect on 1 February 2026; it replaces and supersedes any previous versions.

3. Processing of personal data 

3.1. General principles 

We will only process those types and categories of data which are required for:

* the proper pursuit of our operations;

* compliance with our legal duties;

* protection of our legitimate interests;

whereas processing will be in each case strictly limited to the necessary extent.

3.2. Categories of data subjects; purposes of processing

A) Members / Clients

Purpose: Registration, relationship management, provision of services, communication.

Processed data: First and last name, birth date, contact details (address, e-mail),

payment information, data needed for the provision of the specific service.

Legal grounds: Performance of the contract (Art. 6 (1) (b) GDPR), compliance with a legal obligation (Art. 6 (1) (c) GDPR), Company’s legitimate interest (Art. 6 (1) (f) GDPR).

B) Business partners and suppliers

Purpose: Performance of contracts, administrative tasks, accounting, protection of rights.

Processed data: Identification and contact details, payment information, data created by performance of the contract.

Legal grounds: Performance of the contract (Art. 6 (1) (b) GDPR), compliance with a legal obligation (Art. 6 (1) (c) GDPR), legitimate interest (Art. 6 (1) (f) GDPR).

C) Job seekers

Purpose: Recruitment process, communication.

Processed data: CV, contact details, information on professional qualification.

Legal grounds: Precontractual steps (Art. 6 (1) (b) GDPR), legitimate interest (Art. 6 (1) (f) GDPR).  Storing such data for the future requires the data subject’s consent.

D) Visitors to the website

Purpose: Processing enquiries entered in contact forms, improving website functionality.

Processed data: Data entered in the contact form (name, e-mail, message), cookie data (see Section 6).

Legal grounds: Precontractual steps (Art. 6 (1) (b) GDPR), consent (for advertising cookies and analytics cookies).

E) Marketing

Purpose: Distribution of commercial messages, event management.

Processed data: Name, e-mail, phone number, event footage.

Legal grounds: Consent (Art. 6 (1) (a) GDPR) or legitimate interest (Art. 6 (1) (f) GDPR).

3.3. Automated decision-making and profiling 

We will not use your personal data for making any decisions solely based on automated processing (including profiling) that could produce legal or similarly significant effects for you.

3.4. Transfers of personal data 

We may share your personal data with:

* trusted processors (IT service providers, accountants, legal counsel).

* government authorities, where required by law.

Transfer to third countries: As a rule, we will transfer no personal data to non-EEA countries.  If such transfer occurs in the individual case, we will ensure full compliance with the terms of the GDPR (e.g. by way of an EC adequacy decision or standard contractual clauses).
 

3.5. Data retention periods 

We will store your personal data only for as long as is necessary for its specific, stated purpose:
Contractual relations: Throughout the existence of the contract, and then for as long as statutory limitation and retention periods (in particular as per tax laws) last.

Job seekers: For the duration of the hiring process, but for no more than six months unless you gave consent for us to store your data for future reference.

Consent-based: For as long as consent is valid, and in any case no longer than until its withdrawal.
Marketing contacts: Three years from the last interaction, unless consent is withdrawn earlier.

3.6. Security of processing 

So as to protect your data, we implement appropriate technical and organizational measures, including encryption, access control, regular auditing, and non-disclosure undertakings for all individuals who may come into contact with personal data.

4. Rights of data subjects 

In accordance with the GDPR, you enjoy the following rights:

1. Right of access to your personal data.

2. Right to rectification of inaccurate or incomplete personal data.

3. Right to erasure ("right to be forgotten"), on the terms set out in the GDPR.

4. Right to restrict the processing in certain circumstances, as set out in the law.

5. The right to portability of the personal data which you made available to us based on contract or consent.

6. The right to object to the processing of data based on legitimate interest.

7. The right to withdraw previously given consent at any time, following the same steps as when consent was given.

Exercise of rights and complaints:

Essential cookies: These are processed based on our legitimate interest in the proper functioning of the website.
Other cookies (preference cookies, analytics cookies, advertising cookies): These are always processed based on your consent, which you grant through the cookie banner (cookie pop-up) on your first visit to the website.

You may at any time modify or withdraw your consent:
